Terms & Conditions

These terms govern your use of fliq.co.uk. Please read them before you create an account or publish a listing.

1. Definitions

The terms used in these Terms and Conditions have the following meanings:

  • Terms and Conditions - this document, setting out the general terms and rules for the provision of services through the fliq.co.uk service.
  • Agreement - the agreement for the provision of services through fliq.co.uk, concluded between the fliq Portal and the User.
  • Portal - the fliq.co.uk website, which provides services to Users on the terms set out in these Terms and Conditions and in accordance with applicable law, at the internet domain www.fliq.co.uk.
  • User - a natural person aged 18 or over, a legal person or an organisational unit without legal personality, who may view the descriptions of the Listings published on the Portal as well as other information published on the Portal in accordance with its intended purpose, and also a direct advertiser who may add free Listings in accordance with these Terms and Conditions.
  • Account - the space on the Portal allocated to a given User, which allows them to manage, store and edit the information and listings they have entered.
  • Listing - a set of textual and visual information entered by a User and published on the Portal on the terms set out in these Terms and Conditions.
  • Basic Services - the free services provided in connection with the Portal on the basis of these Terms and Conditions.
  • Additional Services - services which may carry an obligation to pay, provided by the Operator in connection with the Portal on the basis of separate terms available on the Portal, which a direct User may but does not have to use.
  • Services - the services provided electronically by the Service Provider to Users within the meaning of applicable law, consisting in particular of making it possible to publish Listings and to browse them.
  • Service Provider - fliq.co.uk, established in England at fliq, 5 Brayford Square, London, E1 0SG, United Kingdom.

2. Introductory Provisions

By entering the pages of the Portal or by using the fliq.co.uk site, the applications connected with it, email notifications, the API, or any other Service made available by the Service Provider, the User confirms that they understand and accept these terms of use of the Portal.

These terms constitute a legally binding Agreement between the User and the Service Provider which governs the use of the Services.

3. Acceptance of these Terms and Conditions

The User may not use the Services and may not accept the terms of the Agreement if they do not have full legal capacity by reason of their age, or where their capacity to act or their right to use the Services has been restricted under the applicable law that applies in their case.

4. Changes to these Terms and Conditions

These Terms and Conditions and the Privacy Policy may be amended from time to time. Where this happens the User will be notified, other than for changes relating to administrative or legal matters. The User agrees to be informed of changes by their publication on the pages of the Portal, and accepts that their use of the Services after the date on which the amended terms take effect (or any other conduct indicating as much) constitutes their agreement to those terms.

5. Services

The Operator makes a platform available to the User - the Service - which makes it possible to publish, edit, display, browse and search listings, advertisements and other content online. Although Users may use the Services offered by the Service Provider to communicate and to carry out transactions, the Service Provider takes no part in and is not a party to any transaction between Users. The User understands and agrees that they use the Services and take part in those transactions at their own risk.

The Basic Services offered by the Service Provider are free of charge, however the Service Provider may additionally offer paid Services or products.

6. User Accounts

To obtain full access to the Services, the User must create an account on the Portal. To create such an account, the User must provide true information identifying them, including an email address that belongs to them.

The User takes full responsibility for the activity on their Account and agrees that they will not sell, transfer, license (whether for payment or free of charge), share or hand over the Account, or the rights to use it, to any other person or entity. The User is responsible for keeping the password and the details of their Account secure.

The Service Provider is not liable for any loss or damage suffered as a result of the use of the User's Account or password by another person or entity, whether with or without the User's knowledge.

The User agrees that creating more than one Account without the Service Provider's prior consent is prohibited and may result in the user being deleted and blocked.

Creating Accounts by unauthorised means is not permitted, including the use of automated devices, scripts, bots, spiders, crawlers and scrapers, as well as bots and AI.

The User understands that their Account may be closed at any time, in particular where the terms of these Terms and Conditions are broken or where there is an intention to break them.

7. User Content

The Services made available by fliq.co.uk contain the Service Provider's content, the User's content and the content of other Users. That content includes text, software, graphics, images, photographs, sound, music, video, audiovisual content, interactive materials and other materials available through the Services. The Service Provider reserves the right to review a listing before it is published and to accept it or reject it, giving a reason, within 48 hours.

8. Permission to use the Services

The Service Provider grants the User a limited, non-exclusive, non-transferable, worldwide licence allowing access to and use of the Services for personal purposes. This licence is personal and may not be passed on or assigned to another person or entity. This licence permits only the use of and access to the Services in the manner set out in these Terms and Conditions.

9. Rights

The User does not transfer to the Service Provider ownership rights in any content they have posted through the Services. Instead they grant the Service Provider only a non-exclusive, transferable, royalty-free, worldwide licence to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute any content they have posted through the Services.

The User agrees that the Services may be supported by revenue from advertising, and that the Service Provider has the right to display advertising and other promotional material on the Services, next to the Services and in connection with the User's content across all of the Services.

The User is fully responsible for the content they post, and is also responsible for the consequences of posting it, including the use of that content by other people.

The Operator is not responsible for a lack of interest in the content posted by the User. By posting content through the Services, the User declares that they own that content or that they have the right to grant the Service Provider the rights and licences set out in these Terms and Conditions. They further confirm that by posting the content they do not break or infringe the rights of third parties, and they agree to cover any fees and costs arising from the posting of that content.

10. Restrictions on content and on the use of the Services

A private User may hold and use only one account on the Service. They are solely responsible for their conduct and for the content they post or display through the Service Provider's Services, and for any consequences that may arise from this. Listings may be posted only in the appropriate category, and posting duplicate or similar listings in several categories or locations is prohibited.

A business User (agency and developer accounts) may hold and use only one account on the Service. They are responsible for their conduct and for the content they post or display through the Services, and for the conduct and content of their agents, and for any consequences that may arise from this. Listings may be posted only in the appropriate category, and posting duplicate or similar listings in several categories or locations is prohibited.

The Service Provider may intervene in the formatting, layout, content and parameters of a Listing where this is necessary to ensure that the textual and visual information posted by Users complies with the law and with accepted standards, and does not breach these Terms and Conditions, the personal rights of third parties or the interests of the Service Provider.

On the fliq.co.uk Portal it is prohibited to post the following content:

  1. sending other people using the Portal unwanted or unlawful messages by email, through the contact form or by telephone;
  2. publishing on the Portal content that is vulgar, that incites racism or persecution on ethnic, national or religious grounds, that promotes or encourages criminal activity, that infringes the intellectual property rights of third parties, that is offensive or that constitutes an infringement of other legally protected interests;
  3. publishing on the Portal photographs of a property other than the one the listing relates to;
  4. publishing on the Portal other photographs not directly connected with the property being advertised;
  5. posting on the Portal advertisements, logos or links to other websites;
  6. including, within the photographs added, watermarks, captions, text, company names, estate agency names, developer names, telephone numbers or addresses;
  7. publishing on the Portal information that is untrue or misleading;
  8. publishing on the Portal files that breach intellectual property rights and copyright;
  9. using the Portal to encourage Users to use the products or services of any other entities, in particular ones whose activity is similar to that carried on by the Service Provider, without the written consent of the Service Provider;
  10. publishing listings relating to the same property under several different addresses;
  11. publishing listings relating to the same property under several different accounts;
  12. publishing misleading listings, in particular as to the price, location or floor area of the property stated;
  13. publishing listings relating to any services unconnected with the Service Provider's activity and the nature of the service, that is, property.

The User agrees that, where the Service Provider finds that these terms have been broken or breached, or where the Service Provider considers that this was the User's intention, the Service Provider may change the category of, delete or block the listing, the content or part of it.

The following activities are also prohibited:

  • scanning, probing and testing our service and network for cyber security weaknesses, or so-called hacking;
  • acting to obtain access to the non-public parts of our Services, our computer systems or the systems of our partners;
  • forging TCP/IP packets and other parts of packets, both when adding content and in emails, and using the Services in a way that misleads, alters or falsifies information about the source;
  • connecting to the Services, and any attempt to do so, other than through the available interfaces we have published (and only to the extent set out in these Terms and Conditions), unless we have previously given written consent to such activities;
  • indexing our Services with indexing robots is permitted only to the extent set out in the robots.txt file; copying content without obtaining our prior written consent is, however, prohibited;
  • disrupting or attempting to disrupt access to the Services, servers and network, including activities such as flooding, overloading, spamming, sending computer viruses, attacking email, or creating scripts to generate content in a way that interferes with, disrupts or places an excessive load on our Services;
  • attempting to decipher, decompile or reverse engineer the software and code used to provide the Services;
  • impersonating another person or entity;
  • the User using more than one account on the Portal;
  • copying, displaying, collecting, reproducing or otherwise using any content (in whole or in part) posted on or available through our Services without obtaining our prior written consent (this also applies to content posted by the User);
  • sending unsolicited advertising in any form;
  • circumventing blocks on access to the Services;
  • collecting information about other users without their knowledge and prior written consent (this also applies to collecting email addresses and telephone numbers).

If the User carries out any of the prohibited activities above, they agree to pay the Service Provider, on demand, the equivalent of GBP 3,000 for each day on which this term is broken.

The Service Provider also reserves the right to remove the content of a Listing and to block the User's Account in the following cases:

  1. the Listing contains phrases, words or statements generally regarded as offensive;
  2. the Listing is considered by the Operator to be a practice that encourages unfair competition;
  3. the Listing breaches standards of decency, copyright or other intellectual property rights;
  4. the Listing undermines the good name of the Portal, or of entities working with the Portal;
  5. the Listing contains information that does not match the facts and that misleads buyers or customers;
  6. the Listing breaches applicable law and international provisions;
  7. the Listing breaches the rules set out in these Terms and Conditions for adding advertising content to the Portal correctly;
  8. the Listing contains offensive or defamatory content, direct or indirect threats, or incites hatred, or the listing contains content regarded as obscene or indecent;
  9. the Listing directly or indirectly infringes the rights of third parties;
  10. the Listing is presented in the form of spam, or contains content copied from the portal or from another source that is not the User's property;
  11. the Listing contains code within its content (for example HTML) that significantly threatens or burdens the operation of the Portal;
  12. the Listing contains images, video or audio content that is not the User's property and/or that should not be distributed and copied;
  13. the User uses the listing to collect information about Users of the Service, gathering their data and building their own databases;
  14. the Listing contains the data of third parties made available without their consent;
  15. the Listing was added from an Account created by the User after their previous Account was blocked;
  16. the Listing contains content of a sexual or erotic nature, or promotes or encourages visits to sites of that kind, or proposes other activity in that area;
  17. the Listing is an advertisement or sales promotion for any goods, or promotes products through its content, graphics or promotional links;
  18. a listing of similar content relating to the same property or service has already been posted by the User on the service and is active, that is, being displayed (including in another town);
  19. the content of the listing encourages further action, for example sending the advertiser money, stamps or other services, or sending emails in exchange for further instructions or information;
  20. the advertiser's contact details do not match the facts, for example the email address or telephone number does not exist or is blocked;
  21. the Listing contains a telephone number and/or an email address and/or a website address in its title or graphics;
  22. the Listing is not connected in any permitted way with property;
  23. the Listing contains content not listed above which the Service Provider has nevertheless considered inconsistent with the Portal's operating policy.

By creating an Account on the fliq.co.uk Portal, the User agrees to receive by email information about the Portal, changes to these Terms and Conditions, and information connected with the Portal.

By publishing a Listing and the content it contains, including photographs and a telephone number, the User provides them voluntarily to the public and agrees to their disclosure to other Users, in particular to people using the internet. The User's Listings may also be indexed by search engines, of which the User is aware and to which they consent.

11. Age

The Services of the fliq.co.uk Portal are aimed at adults. Under our internal policy we do not make our Services available to people under 18 years of age. The User confirms that they are over 18 and that they may lawfully accept these Terms and Conditions.

12. Paid Services

Most of the Portal's Services are free of charge, however the Service Provider may offer some Services or products for a fee. Where a Service or product is offered for a fee, information about this is published on the Portal. When paying for paid Services, acceptance of the terms of the company handling the payment may be required. The User is therefore responsible for paying for such services together with any applicable taxes.

Where these Terms and Conditions are broken or breached, or where there is a reasonable suspicion that the User intended to break or breach them, the Service Provider reserves the right to withdraw, remove or block a paid Service that the User has ordered or paid for. The User accepts that in such cases, and also where the account is closed, they are not entitled to a refund of the payment.

The Service Provider reserves the right to withhold a payment transaction for paid Services in cases where there is a suspicion that the transaction is not honest, that it breaches these Terms and Conditions, or where the Service Provider considers that by doing so it may prevent a financial loss to itself.

The User understands and agrees that, given the nature of the paid Services offered by the Service Provider, it is not possible to withdraw paid services and products, or orders that have already been processed. The User also accepts that, where a VAT invoice is required, such a request must be made by contacting the Service Provider and by entering the full invoicing details in the account settings before the order is placed and paid for.

If the User resides in the EU, they agree to the performance of the services ordered and waive the right of withdrawal provided for under applicable consumer law.

The User understands and accepts that, in order to offer paid Services, the Operator may rely on payment handling by third parties (so-called "Payment Providers"), and that in such a case the Service Provider of the Portal is not responsible for payment problems that arise on the Payment Provider's side.

The current prices of paid Services are shown on the home page and when promoting a listing; the amount of the fees may change.

13. Copyright and trade marks

Services that contain content belonging to the Service Provider, or content for which the Service Provider holds a licence, are protected by copyright, trade marks, intellectual property rights, international conventions and other applicable law. Accordingly, that content may not be distributed, copied, imitated or used, in whole or in part, without the prior written consent of the Service Provider.

14. Limitation of liability and exclusion of warranties

The Services are provided "as is", and neither the Service Provider, nor its subsidiaries, nor companies operating under the Service Provider's licence can give any warranty in relation to them.

The Service Provider is not involved in transactions between Users. The User accepts and agrees not to hold the Service Provider responsible for the actions and content of other Users. The Service Provider does not guarantee the truthfulness of content posted by other Users, nor the content of communications between Users, nor the quality, safety and legality of offers.

Under no circumstances are the Service Provider, its employees or its representatives liable for direct, indirect, incidental or intentional loss or damage resulting from the use of the Services, including cases where the loss or damage results from an inability to use the Services, from negligence, or from an interruption, suspension, modification, change or termination of the provision of the Services.

The limitation of liability is effective regardless of whether the Service Provider was notified of, or ought to have known about, the possibility of such loss or damage.

Some jurisdictions do not allow the limitation of liability, and in such a case these provisions will not apply to the User.

The Service Provider states that the Services may contain links to the websites (or other sources) of third parties. The User accepts that the Service Provider is not responsible for the availability or the accuracy of such websites or sources. Links to such sites or sources do not mean that we are connected with, or endorse, those websites or sources, nor that we endorse the products or services offered by those websites or sources. The User understands and accepts their own responsibility for the use of such websites and sources.

15. Indemnity

The User agrees to indemnify and hold harmless the Service Provider (and its employees and representatives, subsidiaries, partners, successors and service providers) against any financial claims, to cover all financial costs, including court and litigation costs, and to pay any damages, in the event that the User breaks or breaches any of the terms of these Terms and Conditions or the rights of third parties (including copyright, trade mark rights or other intellectual property rights), or as a result of any other claims for losses that arise from content added by the User.

16. Complaints procedure

The User may make complaints about the non-performance or improper performance of a service by the Service Provider within 14 days of the date on which the display of the Listing ended, or the date on which it should have ended.

A complaint may be made by electronic correspondence to contact@fliq.co.uk, or in the form of a recorded delivery letter sent to fliq, 5 Brayford Square, London, E1 0SG, United Kingdom, marked "Complaint".

A complaint should contain at least: the User's first name and surname, the email address assigned to the User's Account, the URL of the Listing the complaint relates to or other details allowing the Listing to be identified, the display period, the circumstances justifying the complaint, and the User's specific request in connection with the complaint being made.

If the details or information given in the complaint need to be completed, the Service Provider of the Portal will, before considering the complaint, ask the User to complete it to the extent indicated.

The Service Provider of the Portal considers a complaint within 30 days of the date on which a properly made complaint is received. The User will receive information about how the complaint has been dealt with by electronic correspondence, to the email address assigned to their Account.

17. Termination of the Agreement

The terms described in these Terms and Conditions will apply until they are terminated by the User or by the Service Provider in one of the ways described below.

The User may terminate the Agreement at any time by notifying the Service Provider at contact@fliq.co.uk, deactivating their Account and ceasing to use the Services. The notification must be sent before the User deactivates the account. The User accepts that the Service Provider reserves the right to archive, store and process content that the User has added to or through the Services, and that termination of the agreement does not limit that right.

The Service Provider reserves the right to terminate the Agreement or to limit access to all or part of the Services at any time without giving a reason, whether or not it informs the User of this in advance.

On termination of the Agreement, all licences and other rights the User has acquired from the Service Provider cease to apply.

18. General Terms

These Terms and Conditions have been drawn up on the basis of the law applicable to the Service Provider's registered office and are governed by that law, regardless of the application of, or any conflict with, the local law applicable to the User's place of residence.

All claims, legal proceedings and disputes arising in connection with the Services will be resolved before the courts having jurisdiction for the Service Provider or the owner of the Portal, unless the Service Provider or the owner of the Portal decides otherwise.

If the User uses the Services from another country, they are responsible for complying with all the laws that apply in their case.

The User agrees to receive information from the Service Provider in electronic form and accepts that all terms, agreements, notices and other forms of communication received from the Service Provider will be treated as received in writing.

Where these Terms and Conditions are breached by using the Services in an unauthorised manner, the User may not receive any notifications. The User therefore agrees that in such a case all notifications they would have received had they used the Services in an authorised manner will be regarded as delivered.

A failure by the Service Provider to enforce or perform any provision of these Terms and Conditions does not mean a waiver of the right to enforce or perform it.
